Terms of Service
These Terms of Service (“Terms”) govern your access to and use of MakeMyDua (“MakeMyDua” or the “Service”), a service operated by Nuryx Intelligence Corp. (“Nuryx,” “we,” “us,” or “our”), a corporation incorporated in Canada. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Please read carefully. Section 13 (Disclaimers), Section 14 (Limitation of Liability), Section 15 (Indemnification), and Section 17 (Disputes) include important limitations on your legal rights.
1. Eligibility
You must be at least 13 years old to use MakeMyDua (16 years old if you reside in the European Union, United Kingdom, or European Economic Area, or the higher age required by your local law). By using the Service, you confirm that you meet these age requirements and that you have the legal capacity to enter into these Terms. If you use the Service on behalf of another person or organization, you represent that you are authorised to do so.
2. Your Account
You are responsible for keeping your account credentials secure and for everything that happens under your account. Notify us promptly if you believe your account has been compromised. We may refuse, suspend, or terminate any account at our discretion, including for violations of these Terms.
3. The Service
MakeMyDua is a community service that connects users who request a dua with pilgrims travelling for Hajj or Umrah who carry the request. The Service is provided for personal, non-commercial use only. We may add, remove, modify, suspend, or discontinue any feature at any time, with or without notice.
4. Acceptable Use
You agree not to use the Service to:
- Submit content that is unlawful, harmful, fraudulent, threatening, harassing, defamatory, obscene, hateful, or that infringes the rights of others.
- Use the dua submission feature to advertise, promote, solicit, or spam, including political messaging, marketing, or any commercial purpose.
- Impersonate any person or misrepresent your affiliation, location, or status as a pilgrim.
- Attempt to bypass content moderation, location verification, rate limits, or any other technical measure.
- Use automated means (bots, scrapers, scripts) to access, send duas, or fulfil duas on the Service.
- Reverse engineer, decompile, or otherwise attempt to extract source code or data from the Service.
- Interfere with or disrupt the Service, its security, or any user of the Service.
- Violate any applicable law or regulation.
We use a combination of automated tools and human review to detect violations. We may remove content, restrict your account, or terminate your access at any time, with or without notice, where we believe a violation has occurred or is likely to occur.
5. Your Content
You retain ownership of the content you submit to the Service (your dua requests, the notes you write as a pilgrim, your profile information). You are solely responsible for that content and for the consequences of submitting it.
By submitting content, you grant MakeMyDua a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute, and modify that content solely for the purpose of operating, providing, and improving the Service, and for security and legal-compliance purposes. This licence continues for as long as your content remains on the Service (including in our backups). If you delete your content or account, we will take reasonable steps to remove your content within a reasonable period, subject to legal retention requirements.
You represent and warrant that you own or have all necessary rights to the content you submit, and that the content does not violate these Terms or any law.
6. Anonymous Mode
When you fulfil a dua as a pilgrim, you may choose to send your note anonymously. We will make commercially reasonable efforts to display such notes as “A pilgrim” rather than under your name. However, anonymity is a best-effort feature and not a guarantee. We may be required to disclose your identity by law, court order, or to investigate violations of these Terms. Do not rely on anonymity for purposes for which it is not a sufficient safeguard.
7. Pilgrim Verification
MakeMyDua includes features intended to verify that a person carrying a dua is physically located within a recognised Hajj or Umrah region. These features rely on browser-provided geolocation, IP-based geolocation, and other signals, all of which can be inaccurate, can be spoofed, and may be unavailable in certain network conditions.
We do not warrant or guarantee that any pilgrim is actually present at the place they declare, that they actually made the dua, or that any verification badge displayed in the Service is accurate. The verification badge is a community-trust signal and not a legal, religious, or technical proof.
8. No Religious Authority; No Spiritual Guarantee
MakeMyDua is a software platform. We are not a religious authority. We do not provide religious rulings (fatwas), guidance, or interpretations. The Service is not a substitute for personal worship, scholarly counsel, or your own direct supplication.
We make no representation or warranty about the spiritual, religious, or other outcomes of any dua made through the Service. Outcomes rest with Allah alone. By using the Service, you acknowledge that the value of the Service is in connecting people, not in guaranteeing any specific spiritual result.
9. Content Moderation
We use automated systems and may use human review to screen content submitted to the Service. These systems are imperfect: they may flag content that is acceptable and may fail to catch content that violates these Terms. We do not pre-screen all content and we are not responsible for content posted by users. We reserve the right (but have no obligation) to remove or refuse any content at any time, at our sole discretion.
10. Intellectual Property
The Service (including its software, design, layout, graphics, text other than user content, trademarks, logos, and the way features are combined) is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial use, subject to these Terms. No other rights are granted.
11. Third-Party Services
The Service uses or links to third-party services (for example, sign-in providers, email delivery, analytics, hosting, and automated content moderation). We are not responsible for those services or their content, terms, or policies. Your use of any third-party service is subject to that service’s own terms.
12. Termination
You may stop using the Service at any time and may delete your account from the profile settings. We may suspend or terminate your access at any time, with or without notice, for any reason, including if we believe you have violated these Terms or applicable law. Sections that by their nature should survive termination (including Sections 5, 13, 14, 15, 16, and 17) will continue to apply after termination.
13. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by applicable law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, security, and any warranties arising out of course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. We do not warrant the truthfulness, accuracy, or legality of any user content, any pilgrim’s location, identity, or whether any dua was in fact carried as described.
Some jurisdictions do not allow the disclaimer of certain warranties, so some of these disclaimers may not apply to you. In that case, such warranties are limited to the minimum extent permitted by law.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKEMYDUA, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not fully apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify, defend, and hold harmless MakeMyDua and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your content, (c) your violation of these Terms or any law, or (d) your infringement of any third party’s rights.
16. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict-of-laws rules. Where applicable mandatory consumer-protection law of your country of residence grants you stronger rights, those laws will apply to the extent required.
17. Dispute Resolution
Before filing any claim against MakeMyDua, you agree to first attempt to resolve the dispute informally by contacting us at legal@makemydua.com and giving us a reasonable opportunity (no less than sixty (60) days) to resolve it.
To the extent permitted by law, any dispute that cannot be resolved informally will be settled by binding individual arbitration, not in court, seated in Toronto, Ontario, Canada, administered by the ADR Institute of Canada under its applicable arbitration rules. You and Nuryx agree that any dispute resolution will be conducted on an individual basis only and not as a class, consolidated, or representative action, to the maximum extent permitted by applicable law. If this class-action waiver is found to be unenforceable by a court of competent jurisdiction, the rest of this section will continue to apply, but the class-action waiver will not. This section does not prevent either party from seeking interim injunctive relief in a court of competent jurisdiction.
Nothing in this section affects rights you have under the mandatory consumer-protection laws of your country of residence to bring a claim in your local courts where those rights cannot be waived.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by updating the “Last updated” date and, where appropriate, by other means. Your continued use of the Service after the changes take effect means you accept the updated Terms.
19. Miscellaneous
These Terms (together with the Privacy Policy) are the entire agreement between you and MakeMyDua regarding the Service. If any provision is held unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them to an affiliate or successor in connection with a corporate transaction. Any notice we are required to give you may be delivered through the Service or to the email address on your account.
